Your receipt of services by FI International Pty Ltd (referred to in these terms as 'Fast Impressions', 'we' or 'us'), including your attendance at Fast Impressions events, is governed by these terms and conditions. By signing up to become a Fast Impressions member, you agree to be bound by and abide by these terms and conditions.
Please understand that planning a Fast Impressions event is a highly customised, time-consuming process. We do our very best to ensure that each guest is placed at the most suitable event. A cancellation at any time can be a real setback to the process. Your place cannot be reserved or confirmed until payment has been received.
If you have pre-paid and/or paid and booked into an event but do not attend, you are not eligible for a refund under any circumstances (except to the extent that your consumer guarantee rights, which are described later in these terms, entitle you to a refund). If you notify our Customer Service team prior to 7 days of the event that you're unable to attend, we will happily offer you a credit to attend another event.
The sole recourse in the event of dissatisfaction with a Fast Impressions event is to attend another Fast Impressions event at half the advertised cost, unless your consumer guarantee rights entitle you to anything more than that. The customer service and events team at Fast Impressions work hard to ensure that every event has an equal number of men and women. However, some people fail to attend an event even though they have accepted an invitation and paid. Should a significant difference in numbers adversely affect your experience at a speed dating event, or should you meet fewer than 8 people, we will happily book you into another event at half price. Please note that mere dissatisfaction with the people you meet at an event does not entitle you to attend an event at half price.
This may sound rigid, however each event requires a lot of time and effort, and due to the nature of live events there are sometimes factors beyond our control, including but not limited to a lower uptake from one or both sexes, a double booking at a venue, and so on.
Due to the factors set out above, approximately 4% of Fast Impressions events have to be postponed. We recognize that our guests look forward to attending our events and that postponing an event can be extremely frustrating. Please be assured that we make every effort to ensure that all events proceed as planned and only cancel an event when we are confident that the experience for our guests would not be up to the normal high standard. Speed dating relies on there being an approximately equal number of men and women and if there is a significant difference in the number of men and women, or there just aren't enough people overall, then we prefer to choose the lesser of two evils and postpone the event.
If we are not able to fill an event we will reschedule the event (usually no more than two weeks from the original date). You will be notified of the new date by email and SMS the day before the original event (unless we have an unusually large number of people cancelling on the day of the event in which case we will notify you on the day). If this new date is not convenient you will be offered the opportunity to wait for the next suitable event.
No Shows at Events
If you do not show up for a date once you have confirmed that you will attend, your registration fee is forfeit. As mentioned above, however, if you provide us with at least seven days notice we will be able to move you into another event.
People that fail to show up once they have confirmed are also degrading the experience for the other guests. If you know you're not going to be there, please let us know as soon as you can, out of consideration for the other guests. As previously mentioned, speed dating relies on there being approximately an equal number of men and women for the best experience possible.
Fast Impressions holds no responsibility for the outcome of any relationship that may or may not arise between you and another person that you might meet through a Fast Impressions event. Fast Impressions takes no responsibility for the activities of participants, nor of participants at consequential meetings. You agree not to initiate any claim against Fast Impressions resulting from either social or dating activities and agree to hold Fast Impressions free from any liability, except to the extent that the liability was caused by Fast Impressions being negligent or fraudulent, engaging in wilful misconduct, acting unlawfully, or failing to comply with any applicable consumer guarantees.
Removal from Events and Termination of Membership
Fast Impressions reserves the right to remove from any event any individual who has not conducted themselves in a proper manner or who we have received complaints about during the event.
Fast Impressions may terminate your Fast Impressions membership by notice to you if you have engaged in any conduct at a Fast Impressions event or in any consequent correspondence or meetings with an individual who you have met through a Fast Impressions event if Fast Impressions considers, acting reasonably, that the type of conduct is unacceptable because it poses a risk to other Fast Impressions members or may make other members uncomfortable. Fast Impressions may give you a prior opportunity to provide reasons why your membership should not be terminated, but is not required to do so.
Fast Impressions may update or change any of these terms and conditions at any time if the change will not have a material adverse effect on you or your rights.
Otherwise, Fast Impressions may change any of these terms and conditions by giving notice to you. This means that if you book into any Fast Impressions events after having been given notice of a change, then the updated terms will apply. However, the updated terms will not apply to any event for which you have booked prior to being given notice of the change, unless we give you an opportunity to cancel your attendance and receive a full refund on that event.
Fast Impressions reserves the right to alter any aspect of its services including but not limited to venue, theme, start time and pricing, at any time without prior notice. However, we will not materially alter any aspect of an event for which you have already booked, without giving you notice of the change and giving you an opportunity to book into a different event instead of the original event.
We may assign or novate any or all of our rights and obligations under these terms and conditions (and any contract formed between us and you on these terms and conditions) to any of our related bodies corporate, by giving notice to you. We may do this in the event that we and the companies that are related to us decide to change the legal structure of our business. If we do so, either we or the assignee (or both of us) will continue to be bound by these terms and conditions (except to the extent that the terms conditions are changed in accordance with the above paragraphs). You agree to do anything that we reasonably request to give effect to any assignment or novation.
Your Consumer Guarantee Rights
To the extent that you acquire goods or services from us as a consumer within the meaning of the Australian Consumer Law (which is set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), as amended or replaced from time to time), you may have certain rights and remedies (including, without limitation, consumer guarantee rights) that cannot be excluded, restricted or modified by agreement.
Nothing in these terms operates to exclude, restrict or modify the application of any implied condition or warranty, provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute where to do so would contravene that statute or cause any of these terms and conditions to be void.
The cost to attend each event is specified in your invitation or on your "My Details" Page. However, prices for an event can change at any time without prior notice up until the time that you have paid to attend that event. The price will be displayed on the payment page prior to entering credit card details.
From time to time Fast Impressions host events for the media which are filmed, audio recorded or photographed. Email invitations and registration pages for these events will always specify that the event is a media event. By accepting an invitation to a media event you provide permission to both Fast Impressions and the media in question to use the material. The footage, images and audio may appear in printed publications, on television or radio, in member newsletters, and on our website. The media footage, images, audio remain the property of either Fast Impressions and/or the media and may be used at any time.
Photographs at Events
Fast Impressions often takes photographs for publicity purposes. These images may appear in our printed publications, member newsletters and on our website. By registering to become a member you provide permission to Fast Impressions to use your image(s) taken at events in publicity material (newsletter, web page, direct mail etc). Names will not be used.
The Terms and Conditions are current as at September 21, 2013. It may be reviewed and updated from time to time and any changes will be published here.
